Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and HIVIZ LLC ("HIVIZ", "we", "us"). They govern your use of FieldWork, the software available at app.buildonlineliveoffline.com ("the Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the service

FieldWork is a set of AI-assisted tools that help you plan and produce marketing and content assets. Features may change, and we may add, modify, or remove parts of the Service at any time.

3. Accounts

You sign in with a passwordless email link and one-time code. You are responsible for keeping access to your email secure and for activity that happens under your account. Tell us promptly if you believe your account has been used without your permission.

4. Acceptable use

You agree not to:

• Use the Service to break the law or infringe anyone's rights.
• Upload or generate content that is unlawful, harmful, or violates a third party's rights.
• Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its systems.
• Resell or misuse the Service, or use it to build a competing product from our confidential information.

5. Intellectual property

You own the content and inputs you provide, and the outputs generated for you from those inputs, to the extent such outputs can be owned. You are responsible for your content and for making sure you have the rights to it. HIVIZ owns the Service itself, including the software, design, and underlying technology, and nothing in these Terms transfers that ownership to you.

6. AI disclaimer

The Service uses artificial intelligence to generate text and images. AI output may be inaccurate, incomplete, or unsuitable for your situation. You are responsible for reviewing, verifying, and deciding whether to rely on any output before you use it. The output is not professional, legal, financial, medical, or other regulated advice, and it is not a substitute for a qualified professional. Do not rely on the Service for decisions that require such advice.

7. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, secure, or that any output will be accurate or reliable.

8. Limitation of liability

To the fullest extent permitted by law, HIVIZ and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred US dollars.

9. Binding arbitration and class-action waiver

Please read this section carefully. It affects your legal rights. You and HIVIZ agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court. You and HIVIZ waive the right to a jury trial and the right to participate in a class action or class-wide arbitration. Disputes will be resolved only on an individual basis.

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing christian@weareansel.com with your name and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-law rules, except that the arbitration agreement above is governed by the Federal Arbitration Act.

11. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page. Continued use of the Service after an update means you accept the revised Terms.
